These Terms of Service explain the basic conditions for using FirstImpact Med’s website, intake workflow, portal, and related services.
Acceptance of Terms
By accessing the FirstImpact Med website, portal, intake workflow, or related services, you agree to these Terms of Service. If you do not agree, do not use the services.
Additional forms, consents, authorizations, lien agreements, privacy notices, or payment terms may also apply depending on your case.
Description of Services
FirstImpact Med provides safety-first intake, asynchronous injury evaluation support, licensed physician review for eligible cases, medical documentation, and related portal access.
FirstImpact Med does not provide emergency care. Some cases may be redirected to emergency care, same-day in-person evaluation, or another appropriate care pathway.
Eligibility
You must be at least 18 years old to use our services independently. A minor may use the services only with consent and involvement from a parent, legal guardian, or authorized representative as required by law.
FirstImpact Med may decline, pause, or redirect a case if the information provided suggests the patient is not eligible for asynchronous review.
Medical Limitations and Emergency Care
FirstImpact Med is not a replacement for emergency care, 911, an emergency room, or an in-person examination when one is clinically needed.
If you have severe, worsening, or emergency symptoms, call 911 or go to the nearest emergency room. Examples may include trouble breathing, chest pain, severe bleeding, new weakness or numbness, loss of bladder or bowel control, severe head injury symptoms, confusion, fainting, or other urgent warning signs.
Medical recommendations, prescriptions, referrals, or documentation are not guaranteed and depend on physician review and clinical judgment.
Telehealth and Physician Review
Some FirstImpact Med services may be provided through telehealth, asynchronous intake, phone intake, secure portal communication, or physician review of submitted information.
You agree to provide accurate information and understand that asynchronous review has limits. A licensed physician may determine that your case requires in-person evaluation, emergency care, additional information, or another care pathway before documentation or treatment decisions can be completed.
Payment Terms
FirstImpact Med does not currently bill standard health insurance for medico-legal injury evaluations unless otherwise agreed in writing.
Fees, payment options, lien-related payment terms, or deferred payment arrangements will be disclosed before service when applicable. If a lien or deferred-payment pathway applies, separate written agreements may be required.
You are responsible for understanding and accepting the payment terms that apply to your case before services are finalized.
User Responsibilities
You agree to:
- Provide accurate and complete information
- Answer safety and medical-history questions truthfully
- Not use the service for emergencies
- Maintain the confidentiality of your portal login
- Use the services only for lawful purposes
- Not misrepresent your identity, injury, symptoms, representative status, or payment pathway
- Notify us if your symptoms worsen or your information changes
Authorized Representatives
If you authorize a representative to access your case information, FirstImpact Med may share information only as permitted by your signed authorization, applicable law, and platform access controls.
Authorized representative access does not replace physician independence. Clinical decisions remain with the reviewing physician.
Privacy and Health Information
FirstImpact Med handles protected health information according to applicable privacy and security requirements. Our Privacy Policy, HIPAA Compliance page, Notice of Privacy Practices, and any signed authorization forms provide additional information about how health information may be used, disclosed, protected, and accessed.
Intellectual Property
- The FirstImpact Med website, platform content, workflows, forms, branding, software, and related materials are owned by FirstImpact Med or its licensors and are protected by applicable intellectual property laws.
- You may not copy, modify, distribute, reverse engineer, or commercially use FirstImpact Med materials without written permission.
Limitation of Liability
- To the fullest extent permitted by law, FirstImpact Med is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, portal, intake workflow, or related services.
- Nothing in these Terms limits rights or remedies that cannot legally be limited.
Changes to These Terms
We may update these Terms of Service from time to time. Updated terms will be posted on this page. Continued use of the services after updates means you accept the revised terms.
Governing Law
These Terms of Service are governed by the laws of the State of California, except where another state’s law applies by written agreement or applicable law.
